Welcome to JustFabulous! This Web site located at www.justfab.com (this "Site") is owned and operated by JustFabulous, Inc. ("Company"). By purchasing JustFabulous items, you automatically enroll in our JustFabulous VIP Membership Program on the terms described below, ("Terms") so please read these Terms carefully. These Terms are designed to clearly provide to you an overview of the JustFabulous VIP Membership Program and supplement the general Terms of Service of this Site . Please review the general Terms of Service of this Site as those terms also govern your use of this Site and your participation in the JustFabulous VIP Membership Program.

You must be at least 18 years old to purchase JustFabulous products from this Site. The Company reserves the right in its discretion to revise the Terms from time to time so please check them periodically. If you do not agree with these Terms, please immediately cancel your VIP membership by calling one of our customer service representatives at (866) 337-0906.

PROGRAM
JustFabulous is a monthly membership program that grants you access to style experts and the latest shoe, handbag and fashion trends. To become a member, simply take our Fashion Personality Quiz. Our JustFabulous style experts will determine which shoes, handbags or other fashion accessories best match your personality and style. Next, you must register and create a member account through this Site ("Account"). After you have successfully created an Account, you will have the option to select your favorite JustFab item(s) from the 'My Boutique' section of your Account ("Boutique"). There is no registration fee.

As a registered member, our experts will send you a customized selection of JustFab items on the 1st day of every month. You will have the option to purchase any JustFabulous branded item for only $39.95, including but not limited to shoes, bags, jeans, jewelry and other fashion accessories. In addition, from time to time, the Site will offer for purchase additional specialty items created exclusively for JustFabulous by premier trendsetting partners. In order to bring you the most fabulous fashion trends not offered anywhere else, these exclusive specialty items may be offered at prices outside of $39.95. You will also receive emails, newsletters, special offers and other updates to maximize your shopping experience. Once you make your first purchase, you are automatically upgraded to a JustFab VIP member.

As a VIP member, you will be required to take action by the 5th day of every month by selecting one of the Monthly Options described below. These options can be selected through your online account or by calling customer service at (866) 337-0906. You also may cancel your membership at any time. If you do not select the "Skip This Month" option, the "Send Me New Options" option or cancel your membership by the 5th day of the month, your credit card will be billed $39.95 each month. If you select the "Send Me New Options" option, our JustFab stylists will send you new JustFab shoe, handbag, or other fashion accessory options within five (5) business days of choosing to "Send Me New Options". You will then have an additional five (5) days to either select a JustFab item for purchase or choose to "Skip This Month". If you do not select a JustFab item for purchase or choose to "Skip This Month", you will receive a JustFab credit that can be redeemed for the purchase of one JustFabulous item in any future month. Each credit is valid for one (1) year so long as you remain a VIP member. Shipping is always free and all items come with a 30-day return/exchange policy. MONTHLY OPTIONS
Depending on your mood, as a VIP member, you will have the following options each month:

1. 'Send Me Styles.' Select a JustFab item by the 5th day of the month and we will ship it to you for free. If you choose to purchase more than one JustFab item, you may do so at a price of $39.95 each.

2. 'Send Me New Options'. If you are not satisfied with your selections, you may select the 'Send Me New Options' button by the 5th day of the month and our experts will send you a new Boutique selection of JustFab shoes, handbags and/or fashion accessories within five (5) business days ("New Selection"). You will have five (5) additional days from the receipt of the email displaying your new options to select a JustFab item for purchase or select the "Skip This Month" option as described below before your credit card is billed $39.95 and you are given one JustFab credit that can be redeemed for the purchase of one JustFabulous item in any future month. Each credit is valid for one (1) year so long as you remain a VIP member.

3. 'Skip This Month'. There is no obligation to select and buy a JustFab item each month. Should you decide not to select a JustFab item for any given month, simply select the 'Skip This Month' option by the 5th day of the month (or the 5th day following receipt of your new options as described above) and you will not be charged that month. If you do not make a selection or select the 'Skip This Month' option by the 5th day of the month (or the 5th day following receipt of your new options as described above), you will be charged $39.95 and given one JustFab credit that can be redeemed for the purchase of one JustFabulous item in any future month. Each credit is valid for one (1) year so long as you remain a VIP member. Even if you have decided to 'Skip This Month', you may return to your Boutique at any time thereafter to make a selection.

You may cancel your Account at any time. If you wish to cancel your Account, simply call our Fashion Consultants at (866) 337-0906 Mon-Fri 7:00 AM to 7:00 PM PST. There is no additional cancellation fee. Please be advised that an account may only be canceled by the registered VIP member and you will lose any credits in your account should you cancel your account prior to redeeming those credits.

CREDITS
If you have multiple credits, you may redeem them together or separately, in a single month or gradually over time. Each credit is valid for one (1) year from the date of issuance so long as you remain a VIP member. Credits have no cash value and can only be redeemed for a JustFab item selection. Your unused credits become void upon cancellation of your Account for any reason.

You can also gain credits by returning an order for a credit.

To the extent permissible to do so in the jurisdiction where the arbitration is held and (if applicable) the jurisdiction where the parties' obligation to arbitrate claims under these Terms is enforced, both you and Company waive the right to bring any covered claim under these Terms as a class action. In jurisdictions where this is permissible, the arbitrator will not have authority or jurisdiction to consolidate claims of different persons into one proceeding, nor shall the arbitrator have authority or jurisdiction to hear the arbitration as a class action.

In any jurisdiction where the class action waiver described above is not permitted by law or is not enforceable, the issue of whether to certify any alleged or putative class for a class action proceeding must be decided by a court of competent jurisdiction. The arbitrator will not have authority or jurisdiction to decide class certification issues. Until any class certification issues are decided by the court, all arbitration proceedings shall be stayed, and the arbitrator shall take no action with respect to the matter. However, once any issues regarding class certification have been decided by the court, the arbitrator will have authority to decide the substantive claims on an individual or a class basis, as may be determined and directed by the court.

The failure of Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver or relinquishment to any extent of Company's right to assert or rely upon any such provision or right in that or any other instance, and the same shall be and remain in full force and effect. If any provision of these Terms is found by a court of competent jurisdiction, statute, rule or otherwise to be invalid, the parties nevertheless agree that the remaining provisions shall not be affected thereby and shall continue in full force and effect, and such provision may be modified or severed from these Terms to the extent necessary to make such provision enforceable and consistent with the remainder of these Terms.

Company may deliver notice to you by means of electronic mail, a general notice on the Site or by other reliable method.

Company may amend these Terms from time to time. Notice of any change to these Terms will be posted on this Site.
